Is the government weaponizing data?

America’s Frontline Doctors files injunction against COVID vax; Department of Justice declares vax mandates are a go

The COVID pandemic is built on data. Every action by our government in the name of public health relies upon it. Cited numbers of COVID infections and deaths justify everything from ever-fluctuating mask guidance; to how close we can stand next to each other; to how many people can sit in a restaurant; to whether our family and friends bump elbows with us, give us a hug, or wave from a distance. Data is driving what conditions our children will have when schools reopen (or choose not to). It drives whether we can be with our loved ones who are hospitalized or in nursing care.

Clearly the integrity of data about COVID-19 transmission and symptom severity should be of the highest importance to our elected officials. The people who represent us in government are creating or accepting policy that is changing the structure of our society and shaping our future by affecting the mental and physical health of our children. Citizens are told to rely upon the data curated by our government to make decisions in our daily lives, including medical decisions.

Our current administration relies on data for vaccine policy. President Biden is calling for citizens to go door-to-door to promote uptake of vaccines that are not approved by the FDA. And now, with the backing of the Department of Justice, the White House is encouraging businesses, government, schools, and health providers to deny services, access, and employment to those who are not vaccinated.

All of these actions and mandates rest on the foundation of Emergency Use Authorizations (EUA). i EUAs were codified in 2003, as part of the George W. Bush administration’s Project Bioshield, which sought to address anticipated bioterrorist attack threats. Over the next 17 years, EUAs were issued by the FDA dozens of times in response to threats like Anthrax, Ebola, Swine Flu, and Zika. ii

Since January 2020, there’s been a massive surge in EUA use. Over 600 EUAs paved the way for COVID drugs, tests, PPE, and medical devices. iii

Underlying all EUAs is the legal necessity for a declaration of emergency. Without that declaration, every subsequent action ceases to be legal.

There is no emergency

In general, a drug or device will not go to market without FDA approval. EUAs bypass lengthy safety and efficacy studies in the name of an urgent threat. The EUA provision of Project Bioshield anticipated novel biological threats, for which the benefit of swift drug development and access would outweigh the risk of rapid transmission of a biological agent.

Under the law, EUAs require only a declaration by the HHS Secretary of a public health emergency, or a significant potential thereof, which is a threat to national security. iv In 2020, HHS Secretary Alex Azar declared a state of emergency due to COVID on January 31. It was renewed in April, July, October, and again in January 2021. Our current Secretary Xavier Becerra renewed the public health emergency again in April and July 2021. v

America’s Frontline Doctors (AFLDS) filed suit on July 19,2021, with the primary focus of stopping these declarations. The group aims to halt the use of COVID vaccines under EUAs, namely Janssen, Moderna and Pfizer. AFLDS further wants to prevent FDA approval of the vaccines for children, for those who have already been infected with SARS-CoV-2, and for any citizen unable to give “truly voluntary, informed consent.”

The suit is supported by robust statutory, legal, and factual bases. Studies are presented that challenge the public health narrative and government-asserted health and safety data for the novel vaccines. The suit asserts that there is no serious or life-threatening disease, that the vaccines are not effective, that vaccine risks outweigh benefits, there are available approved alternatives, and that health professionals and the general public do not have adequate information to allow for informed choice by individuals. The essence of the suit is that safety data that is crucial for informed consent has been obscured, manipulated, or omitted.

Whistleblower: 45,000 deaths caused by the vaccine

One of the most striking revelations in the suit is an expert opinion that adverse events reported in VAERS are woefully deflated. As of the filing of the suit on July 19, 2021, the number of deaths reported to VAERS associated with COVID vaccines was over 9,000. Whistleblower testimony by an expert in health data analytics estimated the number of deaths within three days of vaccination exceeds reports to VAERS by at least a factor of 5. Under oath, the whistleblower made a conservative estimate of 45,000 deaths after vaccination.

The Biden administration is treating informed consent as expendable under EUAs

We often hear that the COVID vaccines are experimental, but what does that mean? In effect, it means the vaccine development process, which can take up to 15 years from research and discovery through four phases of trials, has been expedited to less than a year.

The AFLDS suit points out, “The American public has not been properly informed of these dramatic departures from the standard testing process and the risks they generate.”

A fact sheet accompanies each vaccine, which states effectively, it is your choice to receive or not receive the vaccine. “Should you decide not to receive it, it will not change your standard medical care.” The statement ends there and does not include any other areas of life that can be impacted by a refusal. It is upon this omission that the DOJ advised the White House that the right to refusal does not “restrict public or private entities from insisting upon vaccination in any context” and imposition of “secondary” or “nonmedical” consequences are not in violation of any law. The U.S. Constitution is notably missing from DOJ analysis of the issue.

According to the DOJ, “Although many entities’ vaccination requirements preserve an individual’s ultimate ‘option’ to refuse an EUA vaccine, they nevertheless impose sometimes-severe adverse consequences for exercising that option (such as not being able to enroll at a university.” (emphasis added)

Beyond consequences for exercising the right to refuse medical intervention, however, the DOJ further advises the White House that informed consent is expendable. In a memorandum it asserts EUA law “directs only that potential vaccine recipients be ‘informed’ of certain information, including ‘the option to accept or refuse administration of the product.” The memorandum continues, “Importantly, however, and consistent with FDA’s views, we also read [the EUA law] as giving FDA some discretion to modify or omit ‘the option to accept or refuse’ notification.” (emphasis added)

In justifying its position, the DOJ relies on statements made in 2003 Project Bioshield hearings by Marc McClellan, former FDA Commissioner, and Dr. Anthony Fauci, then Director of NIAID, “explaining that the informed consent requirements contained in 21 U.S.C. §355(i)(4) do not apply to EUA products.” Dr. Fauci and Mr. McClellan put on congressional record, “[U]rgent situations may require mass inoculations and/or drug treatments, such informed consent requirements may prove impossible to implement within the necessary time frame when trying to achieve the public health goal of protecting Americans from the imminent danger.” vi

The AFLDS lawsuit articulates well the dangers we face as Americans to our informed consent:

“The combined effect of (i) the suppression and censorship of information regarding the risks of the Vaccines, (ii) the failure to inform the public regarding the novel and experimental nature of the mRNA Vaccines, (iii) the suppression and censorship of information regarding alternative treatments, (iv) the failure to inform and properly educate the public that the Vaccines are not in fact “approved” by the FDA, (v) the failure to inform and properly educate the public that the DHHS Secretary has not determined that the Vaccines are “safe and effective” and on the contrary has merely determined that “it is reasonable to believe” that the Vaccines “may be effective” and that the benefits outweigh the risks, (vi) the sustained psychological manipulation of the public through official fear-based messaging regarding COVID-19, draconian countermeasures and a system of rewards and penalties, is to remove any possibility that Vaccine recipients are giving voluntary informed consent to the Vaccines. They have no real option to accept or refuse the Vaccines. They are unwitting, unwilling participants in a large scale, ongoing non-consensual human experiment.” vii

Where do we go from here?

Despite clear executive overreach and abuse of power with respect to Emergency Use Authorizations, the Constitution is still a beacon for those standing up for informed consent and human rights. Justice Alito recently wrote very encouraging words for Americans in a dissenting opinion in one of the first COVID-related cases to reach SCOTUS:

“[A] public health emergency does not give governors and other public officials carte blanche to disregard the Constitution for as long as the medical problem persists. As more medical and scientific evidence becomes available, and as states have time to craft policies in light of that evidence, courts should expect policies that more carefully account for constitutional rights.” viii

While the wheels of the legal system are turning, health freedom advocates do not need to wait for further injury before taking action. Take a moment right now to call for an investigation into the CDC’s data, which has been the basis for so many restrictions on our liberties. Scott Kiley has been married to Jill Kiley for 37 years. Together they have 3 children, 3 grandchildren and reside in Florida. He is an entrepreneur having founded several businesses, one that remains today.

In battling the tyranny that unfolded during the Covid pandemic, Scott uses his organizational and entrepreneurial skills to focus on health care freedom. A former banker turned homeschool mom, Jill Hines began researching alternatives to conventional medicine in 2010 and what she discovered changed the trajectory of her life. Chrissy Scott

A labor and delivery nurse with a lifelong passion for maternal and fetal health, Chrissy Scott left her job of 19 years after learning the truth about the harms caused by the medical system. In 2009, she was mandated by her employer to receive the H1N1 vaccine during her first trimester of pregnancy with her second child. She was assured that the vaccine was “safe and effective” for pregnant women, but her son was born with a kidney defect that could have been fatal. She didn’t connect the dots to vaccine injury until several years later when the declining health of her oldest son drove her to seek answers outside of allopathic medicine.

This personal journey ignited in her a new passion for truth and transparency in health care. As SHF’s Executive Assistant, Chrissy facilitates communication and local advocacy initiatives alongside Leah Wilson for their home state of Indiana. She also manages and creates graphics for SHF’s social media accounts and the website’s swag shop.

Chrissy earned her nursing degree from Anderson University and served her entire career at her local hospital. While she’s no longer a floor nurse, her five very active boys frequently test her nursing skills! She homeschools her children and has been co-owner of a successful home décor sign business with her sister.

Ellen is most energized by working on projects that transform lives. A truth seeker as well as a journalist, she’s disturbed by the lack of accuracy in today’s media and determined to help share fact rather than fiction. Past projects include serving as regional editor of a dog magazine, color and trend specialist for a small cosmetics company, arts columnist, newspaper reporter, ghostwriter, and creator of website content for artists and small businesses.

With a degree in journalism and theatre, Ellen is also a performer. She enjoyed singing and dancing on a cruise ship and traveling with a national musical theatre tour, as well as recording industrial videos, television commercials, and radio voiceovers. She also creates handcrafted jewelry in wire, chain maille, and fused glass.

LEAH WILSON

An attorney with a background in complex litigation and advocacy, Leah Wilson is passionate about children’s health and has researched and worked on child welfare issues for more than a decade.

The overmedication of children in foster care as a form of behavior management is what compelled Leah to become an advocate and foster parent. During her time as a court-appointed special advocate for abused and neglected children, Leah witnessed the rampant use of psychiatric drugs among foster kids. She also discovered that, in addition to many extensive requirements, the state had a policy that all foster children and foster families be fully vaccinated, without exception. Through her involvement in law, health and the foster care system, it became abundantly clear to Leah that the single most important issue affecting child welfare in the United States is the practice of one-size-fits-all medicine via medical mandates. This motivated Leah to expand her advocacy beyond foster care to all children nationwide and to start Stand for Health Freedom (SHF) in 2019.

A graduate of the Saint Louis University School of Law, Leah holds dual bachelor degrees in political science and Spanish from Indiana University. In addition to her advocacy work with SHF, Leah is the owner and former operations director of MaxLiving Indy, one of the largest natural health centers in the Midwest. Designer and visual marketer Bailey Kuykendoll began advocating for health and religious freedom and parental rights in 2014 after learning she was pregnant. A self-described skeptic, she’s not afraid to ask questions and do copious amounts of research to reach her own conclusions.

She’s also not afraid of hard work. As SHF’s Associate Director, Bailey truly keeps the organizational boat afloat. Working closely with our State Directors in each state, she ensures that SHF has calls-to-action for health-freedom bills and petitions on our website and across social media, spreading the word to encourage people to contact their legislators. She builds campaigns, graphics, website pages, and relationships.

Bailey earned a design degree from Harrington Institute of Design in 2008. She then served as a production assistant on several shows for HGTV, followed by working behind the scenes on the X Factor, small indie films, music videos, and documentaries. Bailey joined Health Freedom Florida after moving to the East Coast, becoming co-president of the grassroots organization in 2019. While at Health Freedom Florida, she successfully filed a state bill designed to stop discrimination based on your health status. She joined SHF in the fall of 2020.

Valerie Borek

Valerie Borek is a passionate advocate for health rights and family privacy. A mother of two with degrees in law and biochemistry, she is perfectly positioned to lead SHF advocates through complex health-rights policy. Her work is guided by a love for American values, uncovering truth, and a passion for empowering others. Valerie has served as SHF’s policy analyst since 2021.

Valerie’s understanding of the value of freedom to make one’s own health care choices is not just academic. Health freedom has kept her boys alive and thriving. Her choice to have home births jump-started her advocacy for health privacy. Her eldest son survived a rare and deadly cancer because her family was able to navigate medical care while holding onto values that were sometimes at odds with recommendations.

Before joining SHF, Valerie specialized in health and parenting rights at her boutique law firm, especially surrounding birth and vaccine rights. She advocated for informed consent in health care and transparent food labeling in her state. She helped found the Birth Rights Bar Association and was honored to present their argument to the Delaware Supreme Court that midwifery is not the practice of medicine, in support of a trailblazing midwife.

Mary Katherine LaCroix

Mary Katherine LaCroix became involved with SHF as a volunteer in 2019 when the religious exemption for childhood vaccines was at risk in her home state of New Jersey. She believes strongly that parents have the responsibility for their children’s health, education, and faith formation and that only they have the right to make medical decisions and manage their care.

She has worked in fundraising for more than 25 years at various educational, cultural, human services, and political organizations. A graduate of the University of Scranton, she holds a degree in History and English Literature.

Mary Katherine is thrilled to have this opportunity to work with and help grow SHF, believing that together we can achieve even greater impact in protecting our rights and caring for our loved ones. She enjoys spending time with her husband, two children and large extended family, as well as volunteering to support the special needs community.

Sheila Ealey

Political Analyst

Dr. Sheila Lewis Ealey is the founder and former director of the Creative Learning Center of Louisiana, a therapeutic day school for children who are on the autism spectrum or struggling with other nonverbal intellectual disabilities. The wife of a former U.S. Coast Guard Officer, she is also the mother of four children. Her son was diagnosed with severe autism spectrum disorder at 18 months. He is now a young man and considered moderate and emerging.

Sheila and her twins were featured in the documentary “Vaxxed.” She has traveled extensively, advocating for medical freedom. She continues to educate disenfranchised parents about their fundamental rights to religious and philosophical exemptions, their ability to live sustainably on a limited budget, and the importance of nutrition and biomedical interventions for optimum health with autism. She also writes individual homeschool curriculums for parents of children with autism or intellectual disorders. Sheila is a trustee for the Autism Trust, USA, and on the board of directors of Children’s Health Defense.

Over the past 20 years, she has educated herself to use natural healing modalities for the body and brain. Her formal education includes degrees in communication, special education curriculum, and a doctorate in Educational Leadership in Special Education. Sheila serves as an assistant content advisor and political analyst for SHF.
