If you’re a West Virginia parent who’s been bounced around trying to claim a religious exemption for your child to attend school, here’s the update you’ve been waiting for. A letter from the U.S. Department of Health and Human Services’ Office for Civil Rights (OCR) says WV must recognize religious exemptions to school vaccine requirements, lining up with federal law and West Virginia’s Equal Protection for Religion Act (EPRA, 2023).
How we got here: Gov. Patrick Morrisey signed Executive Order 7-25 his first week in office and told state health officials to set up a simple way for families to request religious exemptions. Families were able to file and attend school last year, but this year they are now being denied exemptions. West Virginians for Health Freedom didn’t back down and appealed to HHS with Stand for Health Freedom on behalf of the families being denied an education. HHS quickly responded backing Governor Morrisey’s order as lawful.
What this means for your family, practically:
- If you already received a religious exemption from the Bureau for Public Health under EO 7-25, keep your paperwork handy and share it with your school. If you’re still told “no,” you can file a civil-rights complaint with HHS OCR.
- If you haven’t applied yet, you can request an exemption through the Bureau for Public Health’s process set up under EO 7-25.

Bottom line: families shouldn’t have to choose between a free public education and sincere religious beliefs. Yesterday’s federal clarification is a step toward common sense public health policy, and it didn’t happen by accident. Religious freedom will likely be restored because West Virginia parents spoke up, WVHF kept pushing, and the Governor opened the door with EO 7-25.
