- UPDATE! The Senate version of this bill has been heard and passed in it’s first committee in the Senate, we now want to see the bill pass in the house, help us put pressure on the Speaker and the Chair to bring the bill forward.
- Representative Miller and Senator Grall filed HB339 / SB408 a simple but exciting bill idea: if a vaccine company pays to advertise a vaccine to Floridians, and that advertised vaccine harms someone, the company should be accountable.
- Right now, companies can heavily promote vaccines through TV ads, online ads, product placement, and even paid influencers, but families often have limited options when something goes wrong. HB 339 / SB408 aims to change that by tying advertising to responsibility.
- Here’s the core protection: if a manufacturer advertises a vaccine in Florida and that vaccine causes harm or injury, the manufacturer can be held liable.
- HB 339 / SB408 gives injured individuals the right to sue, and they have up to 3 years after the cause of action accrues to bring that case.
- If the injured person wins, the court must award:
- actual damages
- court costs
- reasonable attorney fees
- Bottom line for advocates: HB 339 is a “you don’t get to market without accountability” bill, if a company profits from advertising, it should also be responsible if that product causes harm.
