- This bill was brought to the General Assembly by BAYER, the German Pharmaceutical and Chemical Company.
- The bill gives BAYER and all pesticide makers liability protection from any lawsuit based on the label of the product or failure to warn. That’s the vast majority of lawsuits people file that have a shot at holding the companies accountable when they or their property are injured by a pesticide.
- BAYER is threatening to pull their glyphosate products from the market if Tennessee and other states don’t pass shield bills.
- Unfortunately for BAYER, in our free market system, alternative and competing products exist, neutering BAYER’s threats to withdraw their products.
- HB 809/SB 527 shields not just Bayer, but ALL pesticide manufacturers from civil liability, including failure-to-warn claims, at the cost of our federal (7th Amendment) and state (Article I, Section 6 & 17) constitutional rights.
- The bill includes all 15,441 products registered as a “pesticide” in TN and any new products in the future.
- BAYER has a new glyphosate replacement pesticide in development with a 2028 target release date. This potentially billion dollar block-buster product will be patented and BAYER will have exclusive license for years to come. They would love to be shielded from civil liability and failure to warn claims.
- It’s the job of our elected legislators to protect our constitutional rights, not eliminate them when a bullying company demands a shield.
- Roundup and glyphosate do cause cancer. Cancer warnings should be on product labels, but BAYER and the EPA have worked to keep it off.\

- “On June 17, 2022, the Ninth Circuit Court of Appeals issued a decision ordering the Environment Protection Agency (“EPA”) to reexamine its conclusion that glyphosate is “not likely” to cause cancer in humans. . . According to the Ninth Circuit, EPA’s conclusion that glyphosate is “not likely” to cause cancer was inconsistent with other statements the agency made. . .the court vacated the human-health portion of the Interim Decision”
- The General Assembly should be passing legislation to help farmers begin to reduce dependence on chemicals and transition to regenerative and organic farming methods in support of President Trump’s goal, which he stated in his March 6 joint address to Congress: “Our goal is to get toxins out of our environment, poisons out of our food supply, and keep our children healthy and strong.”
