STOP FLORIDA’S CORPORATE “Food Gag” Bills
Our Stand: At-A-Glance
- UPDATE! February 10, 2026 – YOU SUCCESSFULLY got the Ag Gag portion of the bill pulled in the Senate. Thank you for all your action and support, there was even a comment from one Senator who said she wanted to vote no, but all of the civil engagement told her she has to vote yes! B R A V O, Florida. Look what you can do with simple, collective action. We aren’t done yet, we have one more committee to hit, the State Affairs committee in the House. We need to get it removed here as well, so we need you to do what you do best, take action! Write emails, make phone calls and you can even join us in Tallahassee and testify. We don’t have a date for the committee hearing yet, but are guessing it will be early next week. We will keep you posted.
Original Call-to-action here if you are new to this bill:
- Two twin bills have been filed in the state of Florida. These bills expand Florida’s “food libel” law and threaten free speech. We are asking for legislators to strike section 47 in HB433 and section 48 in SB 290.
- The bills expand Florida’s current “food libel” law far beyond its original purpose. it uses vague, overly broad language that could be used against: everyday Floridians, journalists, researchers and advocacy groups like ours!
- These bills make it easier for corporations to sue people for: sharing concerns about food safety, discussing pesticides, additives, or production practices and publishing factual information or opinions.
- They allow companies to claim “harm” if their sales drop after consumers learn information and change purchasing decisions which creates a chilling effect where people stop speaking up because lawsuits are expensive and intimidating.
- These bills claim to stop false statements that harm a food company’s reputation or sales and they frame it as a way to protect producers from misinformation and unfair attacks. but what this bill actually does is:
- Protects corporate profit over the public’s right to know.
- Opens the door for companies to punish speech and silence criticism, even when it’s truthful.
- Discourages honest public discussion about food safety and health.
- And they shift accountability away from producers and onto citizens who speak out.
- ACTION: Email and call the Senate Rules and House State Affairs Committees today and tell them to strike section 47 in HB 433 and section 48 in SB 290.
- PHONE SCRIPT: Use this key message: “Florida must protect free speech and transparency. People should not be threatened with lawsuits for sharing truthful information or opinions about food strike section 47 in HB433.”
- SHARE this alert with friends, family, and local Florida groups who care about health freedom and the First Amendment.
