Repeal Law telling Parents to follow CDC & AAP Schedules
Our Stand: At-A-Glance
- HB1156 (bill language here) was filed to rescind a little-known old Tennessee law, 37-10-401(a), says parents or guardians must get their kids vaccinated according to CDC or American Academy of Pediatrics guidelines.
- The 2025 CDC & AAP Schedules include the RSV antibody injection for babies, annual Covid-19 and Flu shots beginning at age 6 months, and HPV (Gardasil) vaccines at age 9.
- Most Tennessee parents do not and will not follow the full CDC or AAP schedules.
- No other state has this law.
- As the Whereas section of the bill explains, 37-10-401(a) violates the Nondelegation Doctrine by burdening parents with the responsibility of following a schedule over which the General Assembly has no control or oversight.
- Vaccine mandates are a use of police power and that power cannot be delegated to the CDC or AAP.
- 37-10-401(a) is not connected to Tennessee’s daycare or school immunization requirement laws. Those laws are mostly under 49-6-5001.
- This bill DOES NOT change existing child care, pre-school, or school immunization requirements.
- This bill DOES remove an old bad law that should never have been passed.
