URGENT: North Dakota Ask Governor Burgum to sign HB1323 into law.

This bill prohibits the Governor and state health officer from mandating masks.

Our Stand

  • Our final request on this bill is to email and call Governor Burgum to tell him that we would like him to sign this bill into law. Make sure your comments are brief, firm, and always respectful. Remind him that the choice belongs to the thousands of people of ND who care about this issue, not an oligarchy.
  • Below are options of what could happen once the bill lands on the Governor’s desk, quoted from the ND Legislative website: “After the House and the Senate pass a bill, the measure goes to the Governor for consideration. The Governor has three options:
    1. Sign the bill.
    2. Veto the bill, in which case the bill with the veto message must be returned to its house of origin within three days. The Legislative Assembly can override the Governor’s veto by a two-thirds vote of the legislators in both houses.
    3. Refuse to sign the bill. The bill then becomes law without the Governor’s signature.”
  • Jeff Hoverson (R-3) sponsored bill HB1323, calling it “The People’s Bill.” It prevents the ND government from mandating masks at the state, county, and local level, including public schools.
  • HB1323 received a great deal of support from the public and passed the ND House of Representatives by a 50-44 vote.
  • HB1323 then passed the Senate with amendments, by a vote of 30-17. The amendments changed the wording so that cities and school boards can still choose to mandate masks, but the Governor and state health officer cannot.
  • For the people of ND, this bill is about much more than masks. It’s also about reminding state leaders that we the people are fed up with the government telling us what is best for our personal health. This cannot be a “one-size-fits-all” approach. Control over personal health decisions belongs with individuals, not the state.
  • Please share with friends, family, and neighbors, as the more who collectively use their voice, the more the Governor will see where “we the people” stand. This is a great opportunity to remind the Governor that he serves the people, not vice versa.

HB1323 passed the Senate, with amendments, by a vote of 67-24. Previously, the House of Representatives passed HB1323 by a 50-44 vote.
